The 2021 Flows Decree of December 21, 2021 was approved, which establishes the entry quotas for non-EU citizens who intend to invest or work in Italy. Its publication in the Italian Official Gazette is still pending.
A maximum of 69,700 non-EU workers are allowed to enter in Italy for the year 2021, divided as follows:
42,000 seasonal employees in the agricultural and tourism sectors
27,700 non-seasonal employees, of which:
20,000 reserved for citizens of countries who have signed or are about to sign specific cooperation agreements in migration matters with Italy and who enter Italy for non-seasonal subordinate work in the sectors of freight transport, construction and tourism;
2,000 reserved for conversions of residence permits for study, internship or professional training into residence permits for subordinate work and 370 into residence permits for self-employment;
4,400 reserved for conversions of residence permits for seasonal work into residence permits for subordinate work;
500 reserved for self-employment permits for entrepreneurs who intend to set up innovative start-ups or intend to invest in Italy at least 500,000 euros and create three jobs, professionals, shareholders and directors of companies established in Italy, artists.
The quota system works on a first come - first served basis. It is therefore very important to be timely in submitting the application to be included in the quotas.
The application can be submitted:
- from the 10th day following the date of publication of the flows decree in the Official Gazette for non-seasonal employees of certain non-EU nationalities.
- from the 15th day following the date of publication of the flow decree in the Official Gazette for seasonal non-EU workers of any nationality and for non-seasonal workers who are citizens of countries where cooperation agreements in migration matters with Italy will enter into force in 2022
Applications for subordinate work permits submitted within two months from the date of publication of the flow decree in the Official Gazette are allowed.
